Unit Overview:

The unit examines the various aspects of commercial dispute resolution in Australia. Conflict and disputes are a common part of human life and usually unwelcome. The successful treatment and resolution of disputes, either by a party to the dispute and/or someone assisting them, is essential particularly in our commercial world. It is important for commerciality to continue that we recognise and resolve disputes much more quickly, effectively and successfully than is currently the norm.The topics in this subject therefore focus on Alternative Dipute Resolution (ADR) processes and approaches and includes conflict resolution & persuasion, preparation and techniques of successful negotiation, mediation, process, its advantages, problems and limitations, other dispute solutions and a close look at arbitration, including preparing for and advocacy, and the Commercial Arbitration Act 2010 NSW.
